SUMMARY OF LEGAL PROCESS FOLLOWING A MAGISTRATE COURT SUMMONS. KLM has issued summonses for deemed arrear rates and taxes on property owners, many of these without a previous final demand having been received. Legally such a summon without a preceding final demand seems to be possible although we believe this to be counterproductive in view of KLM's proven disregard of proper communications with its property owners in the past. |

Background to legal action by KLM re property rates and services. Introduction: KLM has started to implement legal proceedings against property owners in Kungwini that are deemed to be in arrears with their municipal accounts by approximately R15000 or more. A considerable number of summonses have apparently been issued against property owners that have not received any invoices or statements for the past few years. These summonses usually only contain the amount demanded, with no reconciliation of account attached. Often these summonses were not preceded by a letter of final demand nor a detailed account. |
